While the jury found that MGM and David Copperfield were negligent for a backstage fall Gavin claims caused him brain damage. They also found there was not sufficient proof to hold the casino and magician accountable and that means Gavin Cox was fully liable for his injury.

STORYLINE
RAPE INVESTIGATION INTO DAVID COPPERFIELD CLOSED
Federal prosecutors closed a two-year rape investigation of magician David Copperfield on Tuesday (12 JAN 2010) without filing charges. Police say his accuser made a false sexual assault claim against another man last month.
The illusionist''s lawyers, Angelo Calfo and Patty Eakes, previously said he denied the allegations and called the
lawsuit "extortion for money, plain and simple," but they had no immediate comment on the prosecutor''s decision.
The end of the federal investigation came in a brief court filing by Assistant U.S. Attorney, Susan Roe.
The U.S. attorney''s office in Seattle declined to discuss its reasons, but in a written statement, spokeswoman Emily
Langlie said that generally, investigations may be closed without charges if prosecutors determine there is no federal jurisdiction, no federal laws were broken, or that it would be impossible to prove the charges beyond reasonable doubt.
"Neither the investigation, nor its termination, should be perceived as a comment on guilt or innocence," the statement said.
The woman who made the complaint, a 23-year-old fashion model, waitress and former Miss Washington contestant, said in a related civil lawsuit against Copperfield that she met him when he pulled her out of the crowd and onto the stage
during a performance in Kennewick, in southeastern Washington.
She was later invited to visit his private island in the Bahamas in July 2007.
The woman claimed that once she arrived, Copperfield, whose real name is David Kotkin, sexually assaulted her, in one instance holding her head under water to coerce her.
"She is disappointed, but it wasn''t completely unexpected given the jurisdictional issue of prosecuting him here for
something that happened on his private island," said Rebecca Roe, a lawyer for the woman.
Bellevue Police records obtained by The Associated Press on Tuesday indicate that Copperfield''s accuser made false sexual assault allegations against another man last month.
Police referred the matter to prosecutors for potential charges of prostitution and making a false or misleading statement to a public servant.
According to the investigation reports, the woman was working as a server at a restaurant and decided to meet with a customer for drinks on December 2.
She and another woman met the man, but before long the other woman left - later telling police it was because the other two had become so affectionate toward each other that it was making her uncomfortable.
Copperfield''s accuser and the other man rented a hotel room, and surveillance images included in the police records showed them kissing and holding each other in the lobby.
The woman later exited the hotel room and told hotel staff the man took advantage of her, the police documents said.
She said she was dizzy and couldn''t remember what happened, but only awoke to find him on top of her, police said.

David Copperfield has always been among Dickens’s most popular novels and was his own “favorite child.” The work is semiautobiographical, and, although the title character differs from his creator in many ways, David Copperfield is the story of a young man's adventures on his journey from an unhappy and impoverished childhood to the discovery of his vocation as a successful novelist.
This edition uses the text of the first volume publication of 1850, and includes updated suggestions for further reading, Dickens related early personal experiences that had meant much to him—his work in a factory, his schooling and reading, and (more cursorily) his emergence from parliamentary reporting into successful novel writing.

Hello, I'm Darren. Today I'm going to tell you one of Charles Dickens’ favourite novels. It's the story of a boy called David Copperfield, who survived the cruel treatment of his stepfather but grew up to find true love and success.
David spends his first happy years with his loving mother, a widow, and Pegotty, their devoted housekeeper. Everything changes when Clara Copperfield meets the handsome but cruel Mr Murdstone, who treats David badly. Pegotty takes David to Yarmouth to visit her brother, a fisherman, who has taken two orphans, Ham and Emily, into care. After a wonderful fortnight, David returns to find his mother has married Mr Murdstone. David’s stepfather continues to mistreat him. One day David bites him. Furious, Mr Murdstone takes the opportunity to persuade Clara to send David to boarding school. It’s a grim place, but David meets the dashing Steerforth – the school’s head boy.
Tragedy strikes when David learns that his mother and baby brother have died. He is sent by Mr Murdstone to work in his London wine factory. He lodges with the happy-go-lucky Micawber family, who are always in debt. When the authorities take Mr Micawber off to prison, David runs away to Dover to take refuge with his aunt. Miss Betsy is quite formidable but she takes pity on her nephew and sends him to a good school in Canterbury. He lives with Mr Wickfield, her business manager, and his daughter. Agnes is David’s good angel. David also encounters the scheming Uriah Heep, Mr Wickfield’s clerk. Such a creep and hypocrite! David takes an instant dislike to him and indeed, Uriah will bring ruin to the Wickhams and Aunt Betsy.
David, now 17, leaves school. En route to Yarmouth, he bumps into Steerforth, who travels with him to Yarmouth. There they find Emily and Ham are engaged, though Steerforth seems quite taken with Emily. This doesn’t bode well!

Parts of his own life story found their way into the novel, such as having to work in a factory. Because of this connection, Dickens referred to David Copperfield as his favorite child.
The novel David Copperfield contains many enduring themes, including the importance of life choices, naivete versus maturity, and perseverance. Important symbols include the sea representing death and the uncontrollable forces in life, flowers representing beauty and innocence, and the Blunderstone Rookery representing the poor life choices of David’s father.
